Terms of Service

1. Agreement

These Terms of Service ("Terms") are an agreement between Wynkoop Consulting LLC ("Wyshlist," "we," "us," or "our") and the merchant that installs the Wyshlist app on a Shopify store ("you," "merchant"). These Terms apply to merchants, not to the merchant's shoppers — a shopper's use of a wishlist is part of their relationship with the merchant's store, governed by that store's own policies.

By installing or using Wyshlist, you agree to these Terms. If you do not agree, do not install or use the app.

2. The service

Wyshlist is a Shopify app that lets a merchant's customers save products to a wishlist, gives the merchant analytics on wishlist demand, and lets the merchant run email campaigns and discounts targeted at shoppers who saved a product. Wyshlist depends on an active Shopify store and Shopify account — it is not a standalone service and cannot be used without one.

3. Subscription and billing

• Wyshlist is billed at $9.99 USD per month, with a 14-day free trial for new subscriptions.
• Billing is handled entirely through Shopify's Billing API and appears on your regular Shopify invoice. We do not collect or store payment card details ourselves.
• You can cancel at any time from within the app. Cancelling stops future billing; it does not retroactively refund the current billing period.
• We do not provide refunds for partial subscription periods.

4. Acceptable use

You agree not to:

• Resell, sublicense, or white-label Wyshlist as your own product;
• Reverse-engineer, decompile, or attempt to extract the source code of the app;
• Use the app to violate any applicable law, or to send unlawful, deceptive, or unsolicited communications; or
• Attempt to interfere with or disrupt the app's infrastructure or other merchants' use of it.

5. Merchant responsibilities

You are solely responsible for having a lawful basis and, where required, consent to email your customers. This matters specifically because both Wyshlist's campaign feature and any Shopify Flow workflow you build around Wyshlist's triggers can send marketing email to your customers. Wyshlist's campaign sender checks a shopper's Shopify email-marketing consent before adding them to a campaign, and a real campaign send requires a connected Klaviyo account, which manages consent and unsubscribe on your behalf — but you remain responsible for your own use of Shopify Flow, for the content of any email you send, and for complying with applicable anti-spam and data protection law (including CAN-SPAM, CASL, and GDPR, as applicable to your business).

6. Availability

We make reasonable efforts to keep Wyshlist available and performant, but we do not guarantee any specific level of uptime. The app may be unavailable at times for maintenance, updates, or reasons outside our control (including outages of Shopify or our infrastructure providers).

7. Disclaimer of warranties

Wyshlist is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of liability

To the maximum extent permitted by law, Wynkoop Consulting LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunity, arising from or related to your use of Wyshlist. Our total liability for any claim arising out of these Terms or the app will not exceed the amount you paid us in the three (3) months preceding the event giving rise to the claim.

9. Termination

These Terms remain in effect until you uninstall Wyshlist or we terminate your access. On uninstall, your active session data is removed, and your shop's data is deleted from our database in line with the retention and deletion terms described in our Privacy Policy.

10. Governing law

These Terms are governed by the laws of the State of Oregon, United States, without regard to its conflict-of-laws principles. The state and federal courts located in Oregon will have exclusive jurisdiction over any dispute arising out of these Terms.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date at the top of this page. Continuing to use Wyshlist after a change becomes effective constitutes acceptance of the revised Terms.
